Bill Barr’s Department of Justice announced that SDNY U.S. Attorney Geoffrey Berman had resigned. But now Berman says he has not resigned, and he’s refusing to be fired unless and until the Senate confirms a replacement. Trump has appointed Craig Carpenito, who currently serves as the United States Attorney for the District of New Jersey, to temporarily succeed Berman until Clayton is confirmed. Carpenito will start on July 3rd.

Next up, Senate Majority Leader Mitch McConnell will try to quickly ram through Trump’s nomination of Securities and Exchange Commission Chairman Jay Clayton, which will require 50 Republican Senators to play ball. https://www.cnbc.com/2020/06/19/justice-department-replaces-federal-prosecutor-berman-with-sec-clayton.html
Meanwhile The New York Times reports Jay Clayton “has never served as a prosecutor.” https://www.nytimes.com/2020/06/19/nyregion/us-attorney-manhattan-trump.html
Berman’s office is currently investigating how the president paid for his inaugural celebrations, business dealings by Trump’s son-in-law and special advisor, Jared Kushner, and billions of dollars in loans Trump’s company accepted from Deutsche Bank. Trump’s personal lawyer Rudy Giuliani is reportedly being investigated by Berman’s office to determine if he violated lobbying laws by functioning as Trump’s middle man in Ukraine. Berman also obtained convictions of the president’s prior personal attorney, Michael Cohen, for financial crimes, and also had charged Jeffrey Epstein, a former friend of Trump, with child sex trafficking. https://gothamist.com/news/us-attorney-new-york-investigating-rudy-giuliani-still-job-defying-attorney-general

Trump on firing of Geoffrey Berman: ‘I’m not involved’ https://www.cnn.com/2020/06/20/politics/trump-fires-berman-barr-says/index.html
Hours after Attorney General Bill Barr made a Friday night announcement that Geoffrey Berman, the current U.S. attorney for the Southern District of New York, was stepping down, Berman’s refusal to quit led Barr to notify Berman that Trump had officially fired him, rejecting arguments by Berman that a judicial appointment means he can’t be removed.
In his letter to Berman Barr also states that deputy US attorney Audrey Strauss will take Berman’s job instead of Jay Clayton, the current head of the US Securities and Exchange Commission, as Barr had previously announced. https://www.buzzfeednews.com/article/zoetillman/trump-barr-remove-us-attorney-geoffrey-berman-sdny
Sen. Lindsey Graham said Saturday he will not take up President Trump’s nomination for a new U.S. attorney for Manhattan unless New York’s Democratic senators sign off on it.
Graham’s statement signals an uphill climb for Trump to get a new Senate-confirmed federal prosecutor in one of the nation’s most high-profile districts. https://www.foxnews.com/politics/drama-over-ny-us-attorney-heads-to-capitol-hill
Berman’s office is leading a probe into Trump’s lawyer Rudolph Giuliani and his associates and has also indicted a Turkish state-owned firm involved in an Iran sanctions-busting case which Turkey’s President Recep Tayyip Erdogan has raised with Trump. https://www.cnn.com/2020/06/20/politics/berman-barr-trump-rule-of-law/index.html

“Maybe Bill Barr isn’t that smart. With less than 150 days to the election, Roy Cohn 2.0 emerged from his scrum with Geoffrey Berman, the US attorney for the southern district of New York (SDNY), looking the worse for wear. In less than 24 hours, Barr placed Donald Trump in more jeopardy than he was when their brawl with Berman began late on Friday night.” (Guardian, UK 6.21.20) https://www.theguardian.com/commentisfree/2020/jun/21/donald-trump-geoffrey-berman-sdny-william-barr
[Berman resigned Saturday after Barr assured him that that he would be replaced temporarily with his chief deputy, Audrey Strauss. https://www.axios.com/nadler-barr-deserves-impeachment-time-waste-b4e67a19-b871-4322-9084-3b706620f7d1.html ]
“…Already, Lindsey Graham is heaping praise on Strauss, calling her “highly competent, highly capable” and lauding her for possessing “the knowledge and experience to hit the ground running”. That is not good news for the White House. Graham chairs the Senate judiciary committee.
…Jay Clayton’s shot at the SDNY appears to be evaporating. From the looks of things, Chuck Schumer and Kirstin Gillibrand, New York’s Democratic senators, will be given the right to spike his nomination. They have already vowed to nix his bid, if Graham is to be believed.”
Meanwhile, Rudy Giuliani, who remains under investigation by Berman’s office — suggested Saturday that President Donald Trump may have axed the Manhattan fed because he didn’t manage his staff properly and pursued some “bulls — t” criminal inquiries. https://www.msn.com/en-us/news/politics/giuliani-suggests-trump-may-have-fired-manhattan-us-attorney-berman-due-to-investigations/ar-BB15LNzZ

“A Friday night massacre that backfired” (Jennifer Rubin, Washington Post 6/20/20 updated) https://www.washingtonpost.com/opinions/2020/06/21/friday-night-massacre-that-backfired/
“…This is one of many efforts to fire investigators, including five inspectors general, at least three of whom were looking into Trump administration wrongdoing. (Let’s not forget Barr’s attempt to un-prosecute Michael Flynn after the latter pleaded guilty to lying to the FBI.)”
