In 2007, Melania Trump bought a six-foot-tall portrait of her husband for $20,000 at a charity fundraiser auction at Trump’s Mar-a-Lago Club in Florida.
Later, a check to the charity came from the Donald J. Trump Foundation. Melania Trump is not an officer of that charity, but her husband is its president. Donald Trump’s signature was on the check.
In 2014 the Donald J. Trump Foundation spent $10,000 to buy another portrait of Donald J. Trump. It was later found hanging on the wall of a sports bar at Trump’s Doral golf resort. A spokesman for Trump said later that Trump’s business was actually just “storing” the portrait, on the charity’s behalf.
Under the Internal Revenue Service’s definition of self-dealing (26 CFR § 53.4941(d)-1) leaders of organizations that are exempt from taxation under Section 501(c)(3) are prohibited from using charity money to benefit themselves or their businesses.
In 2019 New York State Supreme Court Judge Saliann Scarpulla ordered President Donald Trump to pay a $2 million judgement for improperly using his charity, including purchasing a 6-foot portrait of himself.
As part of the settlement, Donald Trump Jr. reimbursed the Trump Foundation for the cost of the portrait.
